Alıcı Ön Bilgilendirme Formu ve Mesafeli Satış Sözleşmesi’ne ilişkin bilgileri kendi hesabı üzerinden takip edebilecek ve siparişlerine ilişkin vermiş olduğu bilgileri değiştirebilecektir. Ancak aynı gün teslimat yahut konuma özel teslimat talep edilmesi halinde siparişin oluşturulmasını, diğer teslimat yöntemlerinde Satıcının siparişi onaylamasını müteakip Alıcı teslimat adresinde değişiklik yapamaz. Sözleşme konusu mal ya da hizmetin tüm vergiler dahil satış fiyatı aşağıdaki tabloda gösterilmiştir:

ALICI MALIN BEDELİNİ WWW.DENTYOL.COM’A ÖDEMEKLE, ÜRÜN BEDELİNİ SATICI’YA ÖDEMİŞ SAYILACAKTIR. ALICININ İLGİLİ MEVZUAT KAPSAMINDA CAYMA HAKKI SAKLIDIR. MAL SİPARİŞİNİ TAKİBEN 5 İŞ GÜNÜ İÇERİSİNDE SEVKİYATA BAŞLANACAKTIR. İADE BAŞVURUSU YAPTIĞINIZDA TARAFINIZA BİLDİRİLEN KARGO FİRMASIYLA ÜRÜN İADENİZİ YAPABİLİRSİNİZ. 3.3. Platform kapsamında alıcının bilgisine sunulan fiyatlar ürünlerin satış fiyatlarıdır. Güncellenmesi halinde yeni ilan edilen fiyatlar geçerli olacaktır. Bazı ürünlerin süreli olarak ilan edilen fiyatları, ilanda belirtilen süre bitimine kadar geçerlidir. 3.4. 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği kapsamında satılan mal veya hizmete ilişkin sorumluluk bizzat ve tamamen Satıcı’ya aittir. Ürün sözleşmenin taraflarca sanal ortamdan imzalanmak suretiyle onaylanmasını müteakip 30 iş günü içerisinde Alıcı’ya teslim edilecektir. Alıcı, satın aldığı ürünlerle ilgili şikayetlerini doğrudan Satıcı’ya yapabileceği gibi, WNW kanalıyla da iletebilirler. İletilen şikayetler yetkili birimler vasıtasıyla derhal çözülmeye çalışılacak, mağduriyet varsa giderilecek ve mümkün olan en kısa sürede alıcıya geri dönüş sağlanacaktır. 3.5. Sipariş edilen ürünü ALICI’ya, SATICI'nın isteği üzerine ARACI HİZMET SAĞLAYICISI da ulaştırabilir. ARACI HİZMET SAĞLAYICISI’nın ürünü ALICI'ya ulaştırması durumunda da TKHK hükümleri uygulama alanı bulacak, SATICI’nın ürün üzerindeki ve ALICI’ya karşı sorumluluğu aynen devam edecektir. İşbu sözleşmede yer alan diğer hükümler uygulanabildiği ölçüde, SATICI tarafından bu opsiyonun seçilmesi halinde de uygulama alanı bulacaktır. 4. CAYMA HAKKI: 4.1. Alıcı, 15 (on beş) gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin işbu Mesafeli Satış Sözleşmesinden cayma hakkına sahiptir. Cayma hakkına ilişkin 15 günlük sürenin başlangıç günü farklı durumlarda ayrı ayrı hesaplanmaktadır. Bu farklı durumlar aşağıda sayılmıştır: a. Ayrı ayrı teslim edilen emtealarda alıcının veya alıcının belirlediği üçüncü kişinin malı teslim aldığı gün, b. Teslim konusu eşya, birden fazla parçadan oluşuyor ise Alıcı’nın veya onun belirlediği üçüncü kişinin son parçayı teslim aldığı gün, c. Belirli süre boyunca boyunca malın düzenli teslimatının yapıldığı sözleşmelerde, Alıcı’nın veya onun belirlediği üçüncü kişinin ilk malı teslim aldığı gün. 4.2. Alıcı, cayma hakkını kullanacağını Platform üzerinden Satıcı’ya ulaştırır. Satıcı, bu bildirimin kendisine ulaşmasını müteakip 15 gün içinde mal bedelini iade etmekle yükümlüdür. Alıcı da cayma hakkına ilişkin bildirimini doğrudan Satıcıya veya www.dentyol.com adresine bildirdiği andan itibaren 10 gün içinde malı SATICI’ya geri göndermekle yükümlüdür. Ürünün teslimatının Aracı Hizmet Sağlayıcısı tarafından yapılmış olması durumunda ürün Alıcı tarafından Satıcı’ya değil Aracı Hizmet Sağlayıcısı’na geri gönderilir. 4.3. İadesi gerçekleşecek malın bedeli, Alıcı’ya malı satın alırken kullandığı ödeme yöntemine uygun şekilde ve Alıcı’ya ekstra masraf veya yükümlülük getirmeden yapılacaktır. 4.4. Alıcı, cayma süresi içinde ortaya çıkan gizli ayıplardan veya malı kullanım talimatına ve teknik özelliklerine uygun kullanmasına rağmen ortaya çıkan hasar veya bozulmalardan sorumlu tutulamaz. 4.5. Satıcı tarafından faturanın da ürünle birlikte gönderildiği hallerde, ilgili İADE BÖLÜMÜ belirtilen şekilde doldurulacak ve TÜKETİCİ tarafından imzalanıp, ürün ile birlikte teslim edilecektir. 4.6. Cayma hakkının kullanılması ile birlikte taraflar arasındaki yan sözleşmeler de cezai şart yahut tazminat ödeme yükümlülüğü olmaksızın sona erer. 4.7. Alıcı, aşağıdaki hallerde cayma hakkını kullanamayacaktır: a. Çabuk bozulabilen ve kullanım ömrü kısa olan mallara ilişkin sözleşmeler, b. Alıcının özel isteği veya kişisel ihtiyaçları doğrultusunda hazırlanan ürünlere ilişkin sözleşmeler. c. Malın teslim alınmasını müteakip ürün ambalajının, bandının, koruyucu kılıfının yahut unsurlarının, mührünün Alıcı tarafından açıldığı mallardan iadesi sağlık, hijyen ve tüketim açısından uygun olmayanların teslimine ilişkin her türlü sözleşme, d. Teslimini müteakip başka ürünlerle karışan ve doğası gereği ayrıştırılması mümkün olmayan mallara ilişkin sözleşmeler, e. Gazete, dergi gibi süreli yayınların teslimine ilişkin sözleşmeler (abonelik sözleşmeleri bu kapsamda yer almamaktadır), f. Cayma hakkına ilişkin süre sona ermeden önce, Alıcı’nın onayı ile ifasına başlanan hizmetlere ilişkin sözleşmeler, g. Elektronik ortamda anında ifa edilen veya Alıcı’ya anında teslim edilen gayri maddi mallara ilişkin sözleşmeler. h. Satıcı ve WNW tarafından öngörülmesi mümkün olmayan ve fiyatı finansal piyasadaki dalgalanmalara bağlı olarak değişen ürünler. i. Belirli bir dönem yahut tarihte yapılması gerekli konaklama, eşya taşıma, araba kiralama, yiyecek ve içecek tedarikine ve eğlence veya dinlenme amacıyla yapılan boş zamanın değerlendirilmesine ilişkin sözleşmeler. Yazılım ve programlar, DVD, DIVX, VCD, CD, MD ve videokasetlerle maddi ortamda sunulan kitap, dijital içerik ile bilgisayar ve kırtasiye sarf malzemeleri ürünün kullanılmamış olması ve ürün ambalajının açılmamış ve bozulmamış olması şartına bağlıdır. Sözleşmeye konu ürünlerin Mesafeli Sözleşmeler Yönetmeliği’nin uygulama alanı dışında bırakılmış olan ürün türlerinden (Satıcı’nın düzenli teslimatları ile Alıcı’nın meskenine teslim edilen gıda maddelerinin, içeceklerinin ya da diğer günlük tüketim maddeleri ile seyahat, lokantacılık, eğlence sektörü, konaklama gibi alanlarla ilgili hizmetler) müteşekkil olması halinde Alıcı ve Satıcı arasındaki hukuki ilişkiye Mesafeli Sözleşmeler Yönetmeliği hükümleri uygulanamayacak dolayısıyla Alıcı cayma hakkını kullanamayacaktır. 5. Satın alınan elektronik veya dijital ürünlerin, hangi donanım veya yazılımlarla çalışacağı ile dijital içeriklerin işlevselliğini etkileyecek teknik koruma önlemleri, satın alınan ürünün www.dentyol.com’da satışa sunulduğu sayfasında, ürünün tanıtım kısmında yer alır. Donanımın veya yazılımın fiyata dahil olduğu açıklaması yer almaması halinde sepetteki ücret yalnız ürünü kapsar. Alıcı bu ürünü satın aldıktan sonra gerekli bilgilendirici açıklamaların bulunması halinde, donanımın veya yazılımın fiyata dahil olmadığını bilmediğini iddia edemez. 6. Satışı resmi şekil şartına bağlanmış veya resmi makamlar nezdinde yapılması gerekenler ile, satın alınması veya kullanılması için resmi veya özel işlemler yapılması gereken ürünler için Ön Bilgilendirme Formu ve Mesafeli Satış Sözleşmesi yalnızca bir ön protokol niteliğindedir. Söz konusu ürünün satın alım fiyatında belirtilen bedele, bu madde içerisinde bahsedilen özel veya resmi işlemler ile bunların tamamlanması sırasında ortaya çıkacak masraflar DAHİL DEĞİLDİR. Söz konusu bedeller işlemin tamamlanması esnasında alıcı tarafından karşılanacaktır. Bu satışlar, toplam bedelin Alıcı tarafından Satıcı’ya ödenmesi ve resmi merciler nezdinde resmi işlemlerin yerine getirilmesi ile tamamlanmış sayılır. Bu kapsamda cayma hakkı, kargo, teslimat vb. hükümler uygulama alanı bulamayacaktır. 7. Alıcı’nınalışveriş kredisi ile ödeme seçeneğini seçmesi halinde, Alıcı, Anında/Mesafeli Alışveriş Kredisi Sözleşmesi'nden cayma hakkının, Banka ve Alıcı arasındaki Anında/Mesafeli Alışveriş Kredisi sözleşmesi kapsamında uygulanacağını kabul, beyan ve taahhüt eder. Alıcı'nın SatıcıI ile imzaladığı Mesafeli Satış Sözleşmesi'nden cayması, Banka ile arasındaki Anında/Mesafeli Alışveriş Kredisi Sözleşmesi'ni otomatikman SONA ERDİRMEZ. Alıcı’nın, Anında/Mesafeli Alışveriş Kredisi Sözleşmesi'nden cayması için cayma talebini Anında/Mesafeli Alışveriş Kredisi Sözleşmesi'nde belirtilen süreler içerisinde, yine Anında/Mesafeli Alışveriş Kredisi Sözleşmesi'nde öngörülen usule uygun olarak kredi veren Banka'ya yöneltmesi gerekmektedir. Bu kapsamda, Alıcı tarafından Banka'ya yapılması gereken bildirimin hiç yapılmaması veya geç yapılması durumunda ya da Banka ile Alıcı arasındaki kredi ilişkisi ile ilgili Satıcı’nın hiçbir sorumluluğu doğmayacaktır. 8. GENEL HÜKÜMLER 8.1. Satıcı, sözleşme konusu ürünün sağlam, eksiksiz, siparişte belirtilen niteliklere uygun ve garanti belgesiyle kullanım kılavuzları ile birlikte teslim edilmesi yükümlülüğü altındadır. 8.2. Aksi belirtilmediği müddetçe kargo bedeli Alıcı’ya aittir. Kargo ücreti sipariş toplam tutarına eklenir, ürün bedeline dahil değildir. Teslimat, anlaşmalı kargo şirketi kanalıyla Alıcı’nın yukarıda belirtilen adresinde elden teslim edilir. Teslim anında Alıcı’nın adreste bulunmaması halinde Satıcı edimini tam ve eksiksiz olarak ifa etmiş sayılır bu halde kargo firmasıyla iletişime geçme ve ürün sevkiyatını takip etme Alıcı’nın sorumluluğundadır. Bu itibarla, Alıcı’nın ürünü geç teslim almasından yahut hiç teslim almamasından kaynaklanan zararlardan Satıcı sorumlu tutulamayacaktır. Alıcı adresinin bulunduğu yerde kargo firmasının şubesi yoksa Alıcı’nın ürünü Satıcı tarafından bildirilen yakın bir diğer şubeden teslim alması gerekir. Platform’da ürünle ilgili bilgilerin sergilendiği kısımda tahmini teslimat tarihleri de belirtilmektedir. Bu belirtme, bir taahhüt olarak yorumlanamaz; ürünler Kanunen en geç 30 gün içerisinde Alıcı’ya teslim edilmek zorundadır. Satıcının bu yükümlülüğünü yerine getirmemesi halinde Alıcı sözleşmeyi feshedebilir. 8.3. Alıcı, ürünü teslim aldığı anda ürünü kontrol etmekle yükümlüdür. Böyle bir durumda Alıcı, üründe kargo kaynaklı bir hasar görüyorsa ürünü kabul etmemeli ve kargo firması yetkilisine tutanak tutturmalıdır. Aksi durumda Satıcı hasardan sorumlu tutulamaz. Cayma hakkı olan ürünlerde, Ürün cayma süresi içinde kullanım talimatlarına, olağan işleyişine veya teknik özelliklerine uygun kullanılmamasından ötürü bozulduğu veya bir değişikliğe uğradığı takdirde Alıcı’nın cayma talebinin kabul edilemeyeceği ve her durumda Satıcı’ya karşı sorumlu olacağı, Satıcı’nın kabul ettiği hallerde söz konusu bozukluğu veya değişime göre uygun bulduğu bir tutarı Alıcı’ya yapacağı geri ödemeden mahsup edebileceği Taraflarca kabul edilmektedir. 8.4. Ürün bedelinin ürün teslim alınmadan evvel tamamen ödenmiş olması gerekmektedir. Peşin satışlarda teslimattan önce Ürün bedeli Satıcı’ya tamamen ödenmediği, taksitli satışlarda vadesi gelen taksit tutarı tediye edilmediği takdirde, Satıcı, Alıcı’nın müeccel tüm taksit borçlarını muaccel hale getirebilir, ödenmemeye devam etmesi halinde tek taraflı olarak sözleşmeden dönebilir ve ürünü teslimden kaçınabilir. Ürün teslimatı sonrasında herhangi bir sebepten dolayı, işlem yapılan kredi kartının ait olduğu banka/finans kuruluşunun ürün bedelini Satıcı’ya ödememesi halinde, ürün en geç 3 gün içinde Alıcı tarafından tüm masraf ve giderleri Alıcı’ya ait olmak üzere Satıcı’ya iade edilecektir. 8.5. Satıcı’nın iadeyi kabul etmeksizin ürün bedeli alacağını takip dahil diğer tüm akdi-kanuni hakları ayrıca ve her halde saklıdır. Ayrıca, herhangi bir sebeple banka ve/veya finans kuruluşu tarafından başarısız kodu gönderilen ancak banka ve/veya finans kuruluşu tarafından Satıcı’ya yapılan ödemelere ilişkin Satıcı’nın herhangi bir sorumluluğu bulunmaz. 8.6. İade halinde, Alıcı’nın belirtilen anlaşmalı kargo şirketi dışında bir kargo şirketi ile ürünü kendi iradesi doğrultusunda göndermesi durumunda kargo bedeli ve malın kargo sürecinde uğrayacağı hasardan Satıcı sorumlu tutulamaz. 8.7. Olağanüstü haller veya mücbir sebeplerin varlığı halinde, ürünlerin alıcıya 30 gün içerisinde ulaştırılamayacağı (hali mevcut ise) alıcıya SATICI tarafından bildirilir. Bu durumda ALICI siparişi iptal edebilir veya olağanüstü hal/mücbir sebebin geçmesini SATICININ bilgilendirmesi ışığında bekleyebilir. Satıcı olağanüstü durumlar dışında haklı bir nedenle sözleşme konusu ürünlerin tedarik edilemeyeceğinin anlaşılması halinde durumu öğrenmesinden itibaren 3 gün içerisinde Alıcı’yı bilgilendirerek onayını almak suretiyle eşit kalite ve fiyatta başka bir mal/hizmeti tedarik edebilir. Alıcı onay vermezse sipariş iptaline ilişkin hükümler uygulanır. 8.8. Sipariş iptallerinde ürün bedeli tahsil edilmiş ise Alıcı’ya ilgili banka kanalıyola iade edilir. Kredi kartlı ödemelerde de iade işlemi Alıcı’nın kredi kartına iade sureti ile yapılır ve ürün tutarı, siparişin Alıcı tarafından iptal edilmesinden sonra ilgili bankaya iade edilir. Bu tutarın Alıcı hesabına yansıması ile ilgili süreç Banka ile Alıcı arasında olup Satıcı gecikmelerden sorumlu değildir. 9. UYGULANACAK HUKUK VE UYUŞMAZLIKLARIN ÇÖZÜMÜ 9.1. İşbu Sözleşmenin yorumlanmasında ve uygulanmasında Türkiye Cumhuriyeti Kanunları uygulanacaktır. İşbu Sözleşme ile ilgili olarak ortaya çıkacak ihtilaflarda uyuşmazlık konusunun her yıl Gümrük ve Ticaret Bakanlığı tarafından ilan edilen tutarın/değerin altında kalması halinde Alıcı’nın mal ve hizmeti satın aldığı ve/veya ikametgâhının bulunduğu yerdeki İl veya İlçe Tüketici Hakem Heyetleri, üzerinde olması halinde ise Tüketici Mahkemeleri görevli ve yetkilidir. İşbu Form’da belirtilen ön bilgileri okuduğumu, anladığımı ve onayladığımı teyid ediyorum.

Platform: In accordance with the Law on Intellectual and Artistic Works No. 5846, the Industrial Property Law No. 6769 and the Turkish Commercial Code No. 6102; it refers to the websites, mobile application and mobile site that belong to WNW and are linked to the website www.dentyol.com where the Services specified under this contract are offered. Buyer: It refers to the natural or legal person who becomes a member of the www.dentyol.com website within the scope of the Membership Agreement concluded with WNW and purchases the goods and/or services offered for sale through the advertisements given by the Vendor. Vendor: It refers to the natural or legal person member, service provider who becomes a member of the www.dentyol.com website under this contract with WNW and offers various goods and/or services for sale for commercial or professional purposes through the advertisements published on the account the member has created. Contract:It refers to the subject of any purchase-sale or consumer transaction made or promised to be made in return for a fee or benefit. Service: It refers to the subject of any consumer transaction other than the supply of goods made or promised to be made in return for a fee or benefit. The buyer must approve the distance sales contract in accordance with the Regulation on Distance Contracts in order to purchase the product subject to the contract electronically. The Buyer will be able to follow the information regarding the Preliminary Information Form and the Distance Sales Agreement through its own account and change the information he/she has given regarding its orders. However, if same day delivery or location-specific delivery is requested, the Buyer cannot change the delivery address following the creation of the order and the Seller's approval of the order for other delivery methods. The sales price of the goods or services subject to the contract, including all taxes, is shown in the table below:
THE FEE OF THE SUCH PRODUCT IS COLLECTED FROM THE BUYER BY WWW.DENTYOL.COM ON BEHALF OF THE SELLER WITHIN THE PAYMENT PROTECTION SYSTEM. BY PAYING THE PRICE OF THE GOODS TO WWW.DENTYOL.COM, THE BUYER WILL BE CONSIDERED TO PAY THE PRICE TO THE SELLER. THE BUYER'S RIGHT OF WITHDRAWAL IS RESERVED UNDER RELATED LEGISLATION. SHIPMENT WILL COMMENCE WITHIN 5 WORKING DAYS FOLLOWING THE GOODS ORDER. WHEN YOU APPLY FOR A RETURN, YOU CAN RETURN THE PRODUCT USING THE SHIPPING COMPANY MENTIONED TO YOU. 3.3. The prices presented to the information of the buyer within the scope of the platform are the sales prices of the products. In the case of price changes, the newly announced prices will be valid. The prices of some products that are announced for a period of time are valid until the end of the period specified in the advertisement. 3.4. Responsibility for the goods or services sold within the scope of the Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts rests entirely with the Seller. The product will be delivered to the Buyer within 30 working days after the agreement is signed by the parties in the virtual environment. The Buyer can submit his/her complaints about the purchased products directly to the Seller or through WNW. For complaints submitted, a resolution will be sought out immediately with the concerned departments, should there be any grievance, a resolution will be sought out and the buyer will be reimbursed as soon as possible. 3.5. The INTERMEDIARY SERVICE PROVIDER may also deliver the ordered product to the BUYER at the SELLER's request. In the event that the INTERMEDIARY SERVICE PROVIDER delivers the product to the BUYER upon request of the SELLER, the provisions of TKHK will also be applied to this option to the extent permitted by Law and the SELLER’S liability regarding safe and complete delivery of the products will remain the same. Should this option be selected by the buyer, the relevant provisions stated in this agreement will be applied to the extent that they possibly can be.
4. RIGHT OF WITHDRAWAL: 4.1. The Buyer has the right to withdraw from this Distance Sales Contract within 15 (fifteen) days without giving any reason and without paying any penalty. The starting day of the 15-day period regarding the right of withdrawal is calculated separately in different cases. These different situations are listed below: a. For commodities delivered separately, the day the buyer or the third party determined by the buyer receives the goods, b. If the subject of delivery consists of more than one piece, the day when the Buyer or the third party designated by him/her receives the last piece, c. The day on which the Buyer or the third party designated by him/her receives the first goods in contracts where the goods are delivered regularly for a certain period of time. 4.2. The Buyer provides a notification of withdrawal to the Seller via the Platform. The seller is obliged to return the cost of the goods within 15 days after receiving this notification. The Buyer is also obliged to send the goods back to the SELLER within 10 days from the moment it notifies the Seller directly or www.dentyol.com about its right of withdrawal. If subject product was delivered to the Consumer by the Intermediary Service Provider, goods will be sent back to the Intermediary Service Provider by the Buyer. 4.3. The price of the goods to be returned will be determined in accordance with the payment method used by the Buyer when purchasing the goods and without incurring any extra costs or obligations to the Buyer. 4.4. The Buyer cannot be held responsible for hidden defects that occur during the withdrawal period, or for damage or deterioration that occurs despite using the goods in accordance with the instructions for use and technical specifications. 4.5. In cases where the invoice is sent by the seller with the product, the relevant RETURN SECTION will be filled in as specified, signed by the CONSUMER and delivered with the product. 4.6. With the exercise of the right of withdrawal, the subcontracts between the parties are terminated without any penalty or obligation to pay compensation. 4.7. The Buyer shall not be able to exercise its right of withdrawal in the following cases: a. Contracts for perishable and short-lived goods, b. Contracts for products prepared in line with the buyer's special request or personal needs, c. All kinds of contracts regarding the delivery of the goods whose packaging, band, protective cover or elements and seals have been opened by the Buyer following the receipt of the goods, which are not suitable for return in terms of health, hygiene and consumption, d. Contracts for goods that are mixed with other products after delivery and cannot be separated due to their nature, e. Contracts for the delivery of periodicals such as newspapers and magazines (subscription contracts are not included in this scope), f. Before the expiry of the period regarding the right of withdrawal, contracts regarding the services started with the Buyer's approval, g. Contracts for intangible goods executed instantly in electronic environment or delivered instantly to the Buyer, h. Products that cannot be foreseen by the seller and WNW and whose price changes depending on fluctuations in the financial market, i. Contracts for accommodation, carriage, car rental, food and beverage supply, and leisure time for entertainment or recreation, which must be made for a certain period or date, Software and programs, DVD, DIVX, VCD, CD, MD and video cassettes, books, digital content, computer and stationery consumables are subject to the condition that the product is unused, and the product packaging is unopened and intact. In case the products subject to the contract consist of product types that are excluded from the scope of application of the Distance Contracts Regulation (the regular deliveries of the Seller and the foodstuffs, beverages or other daily consumption items delivered to the Buyer's residence, and services related to areas such as travel, restaurant, entertainment industry, accommodation), the provisions of the Distance Contracts Regulation will not be applicable to the legal relationship between the Buyer and the Seller, so the Buyer will not be able to use his right of withdrawal. 5. The technical protection measures that will affect the functionality of the purchased electronic or digital products, with which hardware or software will work, and the functionality of the digital content are included in the introduction of the product on the page where the purchased product is offered for sale on www.dentyol.com. If there is no explanation that the hardware and software are included in the price, the price in the basket covers only the product. If the necessary informative explanations are found after purchasing this product, the buyer cannot claim that he/she did not know that the hardware or software is not included in the price. 6. The Preliminary Information Form and the Distance Sales Agreement can be considered as a preliminary protocol only for the products whose sale shall be performed with official agreement forms before the governmental entities and for the products that require official or private transactions to be purchased or used. The price stated in the purchase price of the product in question DOES NOT INCLUDE the private or official transactions mentioned in this article and the costs incurred during their completion. The said costs will be borne by the buyer during the completion of the transaction. These sales are deemed to be completed after the total price is paid by the Buyer to the Seller and the official transactions are carried out before the official authorities. In this context, the right of withdrawal, cargo, delivery, etc. provisions will not be applicable. 7. If the Buyer chooses the option to pay with shopping credit, the Buyer accepts, declares and undertakes that the right of withdrawal from the Instant/Distance Shopping Credit Agreement will be implemented within the scope of the Instant/Distance Shopping Credit agreement between the Bank and the Buyer. The Buyer's withdrawal from the Distance Sales Agreement signed with the Seller does NOT automatically TERMINATE the Instant/Distance Shopping Loan Agreement with the Bank. In order for the Buyer to withdraw from the Instant/Distance Shopping Loan Agreement, it is required to direct its withdrawal request to the lending Bank within the periods specified in the Instant/Distance Shopping Loan Agreement, again in accordance with the procedure stipulated in the Instant/Distance Shopping Loan Agreement. In this context, the Seller shall not be liable if the Buyer does not make the required notification to the Bank at all or is made late or for the credit relationship between the Bank and the Buyer. 8. GENERAL PROVISIONS 8.1. The seller is under the obligation to deliver the contracted product in good condition, complete, in accordance with the qualifications specified in the order and together with the user manuals with the warranty certificate. 8.2. Unless otherwise stated, the shipping cost belongs to the Buyer. Shipping fee is added to the total amount of the order, not included in the product price. The delivery is delivered by hand at the Buyer's address specified above, through the contracted courier company. If the Buyer is not present at the address at the time of delivery, the Seller is deemed to have fulfilled its performance fully and completely, in this case it is the Buyer's responsibility to contact the cargo company and follow the product shipment. In this respect, the Seller shall not be held responsible for the damages arising from the Buyer's late delivery or non-delivery of the product. If there is no branch of the courier company in the place where the buyer's address is located, the Buyer must receive the product from another nearby branch notified by the Seller. Estimated delivery dates are also indicated in the section where information about the product is displayed on the platform. This specification cannot be construed as a commitment; By law, the products must be delivered to the Buyer within 30 days at the latest. If the Seller fails to fulfil this obligation, the Buyer may terminate the contract. 8.3. The buyer is obliged to check the product at the time of receipt of the product. In such a case, the Buyer should not accept the product if the product is damaged due to cargo and should keep a report to the cargo company official. Otherwise, the Seller cannot be held responsible for the damage. For products with the right of withdrawal, if the product deteriorates or undergoes a change due to not using it in accordance with the instructions for use, normal operation or technical specifications within the withdrawal period; it is accepted by the Parties that the Buyer's request for withdrawal cannot be accepted and that he/she will be liable to the Seller in any case, and that the Seller may deduct an amount that is deemed appropriate according to the said defect or change, from the refund to be made to the Buyer, in cases where the Seller agrees. 8.4. The product price must be paid in full before the product is received. In case the product price is not fully paid to the Seller before delivery in cash sales, and the due installment amount is not paid in instalment sales, the Seller may make all the Buyer's due instalment debts due, if it continues to be unpaid, it may unilaterally withdraw from the contract and avoid delivery of the product. If, for any reason, after the delivery of the product, the bank/financial institution to which the credit card is processed does not pay the product price to the Seller; the product will be returned to the Seller by the Buyer within 3 days at the latest, at the Buyer's expense. 8.5. All other contractual-legal rights, including the pursuit of the product price, of the Seller without accepting the return, are reserved separately and in any case. In addition, the Seller shall not be liable for any payments made to the Seller by the bank and/or financial institution, but for which a failed code is sent by the bank and/or financial institution for any reason. 8.6. In the case of a return, the Seller cannot be held responsible for the shipping cost and the damage to the goods during the cargo process, if the Buyer sends the product with a cargo company of his/her choosing, other than the specified contracted cargo company. 8.7. In the event of extraordinary circumstances and force majeure, the SELLER must inform the buyer that the products cannot be delivered to the buyer within 30 days (where possible). In this case, the BUYER can cancel the order or wait for the emergency/force majeure to pass in the light of the SELLER's notification. In case it is understood that the products subject to the contract cannot be supplied for a justified reason, except for extraordinary circumstances, the seller may supply other goods/services of equal quality and price by informing the Buyer within 3 days of learning the situation. If the buyer does not approve, provisions regarding the cancellation of an order are applied. 8.8. If the product price is collected in order cancellations, it is returned to the Buyer through the relevant bank. In credit card payments, the refund is made by way of a refund to the Buyer's credit card, and the product amount is returned to the relevant bank after the order is cancelled by the Buyer. The process regarding the reflection of this amount on the Buyer's account is between the Bank and the Buyer, and the Seller is not responsible for any delays. 9. APPLICABLE LAW AND RESOLUTION OF DISPUTES 9.1. The Laws of the Republic of Turkey will be applied in the interpretation and implementation of this Agreement. In the case of disputes that may arise in relation to this Agreement, if the subject of dispute is below the amount/value announced by the Ministry of Customs and Trade every year, the Provincial or District Consumer Arbitration Committees in the place where the Buyer purchased the goods and services and/or where the residence is located are in charge and authorised, if it is above the amount, Consumer Courts are in charge and authorised.
